[The Hwankyung Ilbo] The Ministry of Environment announced that the Amendment to the Environmental Health Act will be enforced from June 12, 2019, which will introduce a punitive compensation system for damages for environmental diseases.

The amendment of the law strengthens the liability for damages caused by deliberate or grave negligence by the operators who caused environmental diseases.

In the law, environmental disease is defined a disease that there is a correlation with environmental harmful factors such as lung disease caused by asbestos and health trouble caused by environmental pollution accident.

The amount of compensation is determined considering the intention of the operator including the harmfulness of environmentally harmful factors, the level of recognition of the risk of damages, and efforts to reduce damages.

“The amendment of the Environmental Health Act is meaningful in that the punitive damages that have been applied only to products are extended to the health damage caused by environmental harmful factors,” said an official of the Ministry of Environment.
